Court cautions civil warrant of arrest against Chayangtajo MLA

Itanagar, Mar 12: A civil court here has warned of issuing a civil warrant of arrest against incumbent Chayangtajo MLA Hayeng Mangfi, a judgment debtor (JD) in the case, if he fails to pay the awarded amount to Apex Bank, the decree holder (DH) in this case, within a span of 45 days.

As per the copy of the judgement order available with NewsFy, the decree holder, represented by Ld Counsel M Karbak, appeared before the court seeking the issuance of a civil warrant of arrest against Mangfi, who was present in person along with Ld Counsel T Taba.

The DH had filed a banker’s cheque dated 31-01-24 of Rs 5000/- bearing no. 776694 in favor of Jully Jail Superintendent seeking the civil warrant of arrest against the MLA, which was later found to be prepared inadvertently.

The DH later requested time to replace it with a demand draft of the same value.

The counsel for Mangfi submitted that the land intended to be sold to pay the awarded amount was mortgaged with the plaintiff bank and a period of one month was not sufficient for conducting the sale of the said property.

The bank had issued a No Objection Certificate (NOC) dated 22-01-24 for the sale of the mortgaged property of Mangfi, to carry out the sale procedure as the awarded amount in the instant case was Rs ten crores.

Mangfi has meanwhile, filed a miscellaneous application seeking some time for the sale of the mortgaged property.

The counsel for the JD requested forty-five days to sell the property to make payment of the awarded amount to the DH, which was not objected to by the counsel for the DH.

The court accordingly allowed the application and disposed of the same, fixing the next hearing on 12-04-24.

The court also warned that if the payment is not made within the given time, a civil warrant of arrest may be issued against the MLA.

Mangfi reacts:

Reacting to the development, Mangfi said the matter is still sub-judice and the said case is between him and the bank which makes it a personal one.

“I have enough property to sell and pay off the loan and I know how to do the same. Also, I am not an insolvent yet as claimed by my opposition, so I once again request the third parties to refrain from interfering in the matter,” he said.

Mangfi also asked his opposition to fight the elections based on ideologies and not personal attacks.

Allegations:

It may be mentioned here that former All Arunachal Pradesh Students’ Union (AAPSU) president Hawa Bagang had on Monday accused Mangfi of using fraudulent means to obtain a No Objection Certificate (NOC) to waive off Rs 34 crores in loaned interest from the Apex bank.

Bagang, who is also a candidate for the 9th Chayangtajo Assembly Constituency in the upcoming 2024 assembly election has also urged the BJP party authorities to suspend any political endorsements and ticket allocations to Mangfi until the entire due interest is settled.

Mangfi has on the other hand expressed willingness to accept the court’s direction, which is now expected on April 12.
